Terms of Service

Please read these Terms of Service carefully before using Sexxy Market. By accessing or placing an order on our platform you agree to be bound by them.

1. Acceptance of Terms

By accessing or using Sexxy Market ("the Platform"), you confirm that you are at least 18 years of age, legally able to enter binding contracts in your jurisdiction, and agree to be bound by these Terms of Service. If you do not agree, you must stop using the Platform immediately.

2. Age Verification

The Platform sells adult products intended exclusively for individuals aged 18 and above. We reserve the right to request proof of age at any time and to suspend or terminate accounts where age requirements are not met. Misrepresenting your age is a violation of these terms and may result in permanent account closure.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@sexxymarket.com if you suspect any unauthorised use. We are not liable for any loss or damage arising from your failure to protect your credentials.

4. Prohibited Conduct

You agree not to: (a) list or purchase products that are illegal under Nigerian law; (b) engage in fraud, chargebacks, or misrepresentation; (c) harass, abuse, or threaten other users or merchants; (d) attempt to reverse-engineer, scrape, or disrupt the Platform; (e) use the Platform for money laundering or any other financial crime; (f) create multiple accounts to circumvent suspensions.

5. Product Listings & Merchant Obligations

Merchants are solely responsible for the accuracy of their product descriptions, pricing, and stock levels. All products must comply with Nigerian law. Sexxy Market reserves the right to remove any listing at its discretion. Merchants must maintain a minimum fulfilment standard; failure to do so may result in account suspension and/or financial penalties.

6. Orders, Payments & Refunds

All transactions are processed in Nigerian Naira (₦) via Paystack. By placing an order you authorise the charge to your selected payment method. Refunds are subject to our Refund Policy: items must be returned in original condition within 7 days of delivery; digital goods are non-refundable. Sexxy Market is not responsible for payment failures caused by your bank or card issuer.

7. Delivery & Risk

Risk of loss passes to you upon delivery confirmation. Delivery timelines are estimates only. We are not liable for delays caused by third-party logistics providers, natural disasters, or other events beyond our reasonable control. Ensure your delivery address is accurate; reshipping fees apply for returned parcels due to incorrect addresses.

8. Intellectual Property

All content on the Platform — including logos, graphics, product photography, and software — is the property of Sexxy Market or its licensors and is protected by Nigerian and international copyright law. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Sexxy Market shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid for the specific transaction giving rise to the claim.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection and processing of your personal data as described therein.

11. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms shall first be submitted to mediation. If mediation fails, disputes shall be resolved by binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after the effective date of changes constitutes acceptance. If you disagree with any changes, you must stop using the Platform.
